Tom Cruise and Katie Holmes have reached a divorce settlement, and as RadarOnline.com exclusively reported first, she will have primary custody of their daughter Suri Cruise.

Katie will continue to live in New York City with Suri, 6, and RadarOnline.com has exclusive details about Tom’s visitation rights, and one point that was important to Katie was that nanny and bodyguards she hired continue to be with Suri.

"Katie insisted that Suri's nanny and bodyguards always accompany her when she visits Tom. Katie did this for several reasons. This will ensure a smooth and easy transition for Suri when she is with Tom.

“Suri is Katie's number one priority. Tom only has Scientologists that work for him and Katie insisted that her staff will always be with their daughter. Under terms of the settlement, Suri isn't permitted to be exposed to anything Scientology related and this includes going to any Scientology churches, parties, etc. Katie made sure that this was ironclad in the agreement," a source close to the situation tells RadarOnline.com.

Katie Holmes may have missed her calling. She would have made a nifty secret agent!

The actress started taking action to divorce Tom Cruise via disposable cell phone so as to keep her conversations with her lawyers private (and, it would seem, a secret from her husband), the Los Angeles Times reported Tuesday.

Her divorce filing was immediately sealed, but Holmes is rumored to have stated that her marriage broke down sometime last year. She also spent part of every month for the last two years in New York, possibly as a precursor to filing for divorce in that state, where residency is required.

The L.A. Times further reports that Holmes entrusted a friend to obtain the cell phone for her, which she then used to line up legal representation in New York, where she filed the paperwork, and California.

Cruise and Holmes announced yesterday that they had arrived at a mutually agreeable divorce settlement, and while their lawyers are remaining mum on details, it's being widely reported that Suri will live primarily with her mom and dad will be the visiting parent.

Katie Holmes stands to receive as much as $50 million in her divorce settlement from Tom Cruise, according to prominent LA family attorney Lisa Helfend Meyer.

Meyer told Celebuzz Cruise may be required to pay anywhere between $20 to $50 million as a lump sum for the high profile split, and that is before child support!
Katie will add this to her own $25 million money that she earned.


There were also previous reports that she would get the couple's $35million (£22million) Beverly Hills mansion. The couple also had a second mansion in the Hollywood Hills, worth £10million, a mountain retreat and another £12million home in New York’s Greenwich Village
