The new phone, iPhone 4S comes with the new software, iOS 5, installed. Older phones, iPhone 4 and iPhone 3GS, can download the new software, iOS 5, without access to all of its features starting now.

Yeah, I'm pretty sure you'll get at least a few of the convenient features, like the Notification Center. I'm not sure how much it'll impact the performance of a 3GS, though. I remember the iOS 4 software was a deal-breaker for my 3G because of how poorly it ran.
