I'm sure he would have been found not guilty if this did go to court anyway but still.

A grand jury does hear the testimony of witnesses. What happened is that the evidence against the officer was so weak and insufficient that a trial would not be advisable. What hurt the case was the fact that some witnesses changed their accounts after new evidence surfaced to fit the new evidence.
