^Why not? If they re-release it as a 2008 mix it would be allowed.
I thought remix won't be able to get charted? Only when the remix sounds different until a point it can be considered a new song, then yes (like love in this club pt1 and pt2). And in this case, i don't think it will go very far on the chart. The original is a classic.
Anyway - IIWAB is doing big things on radio, across many formats. It's hardly a flop.
