I think you're misreading the full story. This was the legal battle prior to today, quoting label representatives denying Kesha's request to record new material. Today, however, they are saying she
can continue to record (without the involvement of the alleged) but she's
now refused any involvement with the label all together, completely contradicting her previous request. Hence why the judge didn't make a ruling in her favour because she's refusing to comply with the legally binding contract...
Really, whomever's working in her favour should be taking notes at what they're offering her.. and Sony has evidence that she was working just last year amidst all of this. They're not stupid. She's literally trapped either way. She's going to lose.
Sony will claim they've offered her continuous work, protecting her from the alleged rapist, she's refused, therefore not complying with the contract. She'll still have no evidence to break the contract on the grounds of gross misconduct. If however Kesha changes her mind and accepts the offer of working with other producers, publishers, etc,
who is actually going to want to work with a woman that has recently been involved with sexual harassment claims? Lose-lose situation.
