No, they're not. Especially not with a good legal team as well as a signed agreement which virtually all companies that work with sensitive information (pretty much all of them) have their employees sign upon getting hired. That is how companies can hold employees legally accountable considering the sensitive information that can go through so many hands in a place of business.
And he didn't have to break a federal law because two states were involved. The end consumer of his video is based in California, but he stole the video in NY, distributed it and breached an NDA to do so. And the security footage IS intellectual property.
