I'm not saying Britney is a has been, but that comment you quoted was listing a reason why they thought that she is a has been. So the fact that she did it ages ago doesn't really help the situation.

I don't see a struggle. I'd understand if she was flopping single-wise from era to era but it's just one era and she is not struggling to get a Platinum album either

Britney's been there and done that as far as the Super Bowl is concerned, so that does not matter as much. And Reality TV is in a different place than it was 10 years ago when Paula Abdul was good enough. Now star power is important on competitions and it says a lot about Britney's status that Simon wanted to get her and was able to. Her salary does not lie either.

That's like me saying Rihanna was only in the news from her abuse. But I know that's not true. There are many times she's been in the news.

And as for 2012, Beyonce had a baby on the 7th day of 2012, got tons of exposure once she stepped out for the first time, released her tumblr of personal photos which got tons of press (including the first pictures of her daughter), was named People's Most Beautiful Woman in the World (tons of press), did Revel... as well as all the other stuff you've mentioned. And she was on a break. So I don't see how she's not in the news.
