How is Cobra Starship nominated when they're not new artists?

Apparently Grammy rules (according to the people in the GoldDerby Forums, where these predictions were posted) say that an artist who has been nominated before for a Grammy cannot be eligible for Best New Artist, and conversely, any artist who just brst into the mainstream scene (even having several albums previously released) which has not yet received a Grammy nod is still eligible for BNA.
Thus, many predict that Cobra Starship is a front-runner for BNA this year. Lady Gaga, on the other hand, may not be eligible since she received a Best Dance Recoding nod last year for "Just Dance." Because the field seems so weak, though, they may make some changes and allow Gaga in, which would be fine, since she'd at least be nominated for her FIRST album (which other BNA nominees can't really say...).
Who knows, though?? Sometimes you can tell the Grammy people do things for ratings (i.e., nominate the Jonas Brothers) while others they just seem to obstinately follow the rules even though it makes no sense to do so...
