Many people are confusing the FBI's national security function with its law enforcement function. If the FBI ran across information justifying criminal charges, they would follow it, so we can't 100% rule it out, but no one has suggested that has happened or is likely to happen. The referral to the FBI by State and Justice explicitly said it was not a criminal referral, and the latest report from the State IG confirms that no criminal violations were found. So this report had nothing to do with criminality as an internal audit. It does however imply that she likely violated the Federal Records Act. But the thing is that the Federal Records Act has no criminal sanctions for non-compliance. As well as the act not even covering electronic communications until late 2014.

So even if she did violate the FRA, there are no criminal charges that would be filed for it.

This is correct. As someone currently working in cyber security research, this is correct.

An easy way to explain it would be... it would be comparable to someone trying to break into your Facebook account by using your email address but not providing the right password, so they never accomplished acquiring access to your Facebook Account. A compromise of security would be if that same person was able to successfully guess your password. As you can see, very different situations.

It's not that I care about her doing it (I don't) but this is exactly the reason why her unstrustworthy numbers are at rock bottom and why her unfavorable numbers are high. It's so annoying how it popped up right now.

What we learned actually wraps some things up, but opens a new conversation.

The fact that those released emails and when the State Department told us thousands of the emails were classified was actually more terrifying for her, and she still won. The real issue from now on is the FBI investigation.
