How is it sad? Artists get sued all the time. Sometimes they win the case, sometimes they lose. Copyright infringement of music can often be difficult to determine since many similarities can be the result of coincidence rather than copying. Toby Fad seems like a credible producer/writer, with years of experience. We are just waiting to see how this plays out. No need to freak out.
There are many potential defenses for a big record label such as HWR against that small band. And if it turns out that they need to pay, then so be it.
I wanna see this damn story on TMZ though. And I want people to check out AYWR on itunes, give that flawless song some exposure, don't care who gets to keep the money.

The song has the nametag "Selena Gomez & The Scene". And Selena made money from it.
That is why Selena is the one being sued, it's her name that's linked to the song, so it's HER song.
At least that's how I understand it.
I'm also confused at it being Toby Gad... I just hope this will not go through... :s

It happening more often doesn't make it not sad though...

I don't know much about american law. But here she would still be liable, since she made money off it, like I think you said earlier. Eventually the main one being sued will be Toby Gad.
Selena and HWR and whomever else made some money off it, they're liable too, even if they didn't know the song was a rip-off.
Copyright infringement cases are very hard to prove though. And even if they have to pay, a settlement or whatever, I see HWR carrying the heaviest burden. Goodbye 4thsingle?
