I don't think he can be. Apparently , according to Florida Law, his action was considered as "self defense. (although it's stressed to call the police first)
Instead of telling people of other races that not all black men who wear hoodies are criminals or dangerous, he says that it is the reason the person was killed and that parents shouldn't let their kids walk out of the house with one. His statement was too insensitive and stupid.
