You can always just ask the member if you can use it. Or just save the avatar and when the member stops using it, make it your own. 95% of members don't really care either way. But there are those 5% who are very protective of their avatars.
They're like rednecks hoarders, sitting in front of their porches with a shotgun,
protecting a garage full of old avatars that they don't want anyone to touch.
