Yep, the ONE way he loses is if he claims, in any capacity, that Mexico is paying for the wall. Literally the only way he loses. In fact, he can never make that claim again.

The 4-4 tie is a preview of what's to come. That means that Wisconsin/Texas and a few other state laws like NC's are done. It also sets a precedent so any neighboring state that's bundled in that Appeals Court and still doesn't have a case will come out victorious in the future
