The teacher should have DOCUMENTED these ongoing incidents - believe me, when students begin doing such stuff in my classroom, I document it like crazy. If the students harassed the teacher on a particular day, fill out a behavior log and make the punk sign it. If he refuses, write in that he refused.
Second, he should have issued a reprimand for HARASSMENT rather than inappropriate statements. Suspending the kid JUST for saying he believes homosexuality is a bit extreme - had the teacher had sufficient documentation/evidence, the teacher could have simply issued a reprimand for harassment. Even better, he/she could have invoked their right to remove a student from the classroom.
Unfortunately, now it's just a he said she said thing. The teacher dropped the ball on this one. And unfortunately, from a legal standpoint, the kid's lawyer is right.
