I think the "constant negative publicity" isn't as constant as you assume. Honestly, when we take off our blinders and look at the real world, we realize that very little of the general population detects musical nuances such as having the same chord progression.

But the reality is that these comparisons wouldn't come so frequently if people weren't so desperate to bring her down. You know it's a loss when people are bringing up La Isla Bonita at any point, even if it was last year.
