I think it would be nominated, It was only eligible for 2009, her image was already good by then...
and most of the relevant critic groups jumped on it as soon as it was released, although there was some backlash like "This makes even Paris Hilton album sound acoustic" but It was agreed after all (and before Circus) it was her best album.
Her image was recovered by mid-2008, and the nominations would only be in the end of 2008...
It was a given....
But I guess they didn't want Grammys for her best work, As far as I remember, they didn't send "Gimme More" for Electronic record or even "Piece Of Me" for Pop vocals, only the latter for "Record Of The Year" -- ROTY are usually mainstream songs that made abnormal success... They only sent it to say "We've send her"
