When it first emerged, it was mostly seen as used by blacks and latinos so the minimum sentencing was like 5 years of jail time for using. Then white people starting using it en mass in the 70s so they scaled back its punishment.
As long as it's attached to black and latinos, it won't be legalized. The best campaign for it's legalization is to make a case that it's the drug of choice for a large population of white suburban youth. But currently, it's still attached to blacks and latinos.
