There are legitimate reasons for somebody to want to pursue civil suit in addition to pressing criminal charges -- the burden of proof is lower; there is more incentive to settle than accept a plea bargain (which requires admission of guilt); and it allows you sole authority on how you wish to proceed / what terms you will accept instead of having it in the hands of the D.A.

It makes total sense as a safety net to try to maximize the likelihood that the defendant suffers some consequence for any wrongdoing since you can be found not guilty in a criminal case and still have judgment rendered against you in a civil suit arising from the same charges.

That being said -- I am not really sure what the incentive would be for someone to not go ahead and press criminal charges against somebody unless they were concerned that the D.A. might not feel there was sufficient evidence that would compel them to file a criminal complaint which could potentially serve to undermine the credibility of her case in civil proceeding.

lol you framing it as a flop is not working, it almost cracked $200Mill domestic. Its multiple was almost 3x as well. Winter Soldier wasn't doing it, Thor really wasn't doing it (barely performed better than Godzilla ) '

GOTG was huge yas, but that's due to Marvel being arguably the biggest brand at the movies right now. "No name space aliens" please they had backing from Disney/Marvel as if they were gonna do less than $175Mill domestic.

TMNT had no bankable leads, and was relying on a franchise whose last outing did barely $54Mill. Michael Bae reboot or not, it was a massive success. No one on earth will agree with your assessment.
