The moderator who processed the report saw the post as not being off-topic or, more likely as it is from 5 days ago, too old to warrant warning.

That's the point, though - the unreleased material is illegal in all the same respects as the released material, and we don't want our site to associate with illegal file sharing. The unreleased stuff will get ATRL sued or shut down just the same as the other material.
