But i can still post that gif in any other context right?
It's not just a gif of people laughing, so you can't really use it as a laughing gif. In other contexts you're either shading Ke$ha with it or being off topic/disruptive. So while I can't say it must always be warned anywhere, my advice is to leave it in SYG if you want to be safe from WPs.

It's a gif of people literally laughing at what Ke$ha looks like.
If that's not flamebait I don't know what is, honestly.
Two nights ago, I reported a post with that gif AFTER it was made clear that it was flame bait, but it was cleared and the post remains unwarned. Any hints as to why this rule is inconsistent?

Nothing on ATRL is consistent. We should all know that by now.

We had a long discussion about this one gif. The things we spend time on as mods.
I'm not complaining about the inconsistency, but far too many members expect the warning system to be perfect and exact for every single reported post. There's multiple mods with multiple opinions, stop comparing posts when they've most likely been moderated by different people.

How do i get a WP for telling him to stfu.. but he doesn't get one for flamebait ?
Depends on how you present your opinion.
The keyword in what Kworb said is "He was just giving his opinion about the topic."
It was just an opinion, but not flamebait.

Especially when it's a large staff of 15 people. Consistency will be next to impossible to achieve, ESPECIALLY when there's a subjective component about moderation. I wish more people would understand this
