If the person who is intoxicated is forced to have sex against their free will then it's rape. If both parties are drunk then it's not rape, otherwise bars/clubs would be known as places to get raped, which is totally not the case.
Being drunk doesn't mean you have no control/don't know what you're doing. That's a very old belief. Obviously if both parties agreed to do it, it's not rape. If one party forcefully took the other party's clothes off, it's rape.
Being high in drugs though, I'd consider rape though.

mess. you're more aware of your actions when you're on drugs than when you're drunk. I've never heard somebody say "they took advantage of me when I was high" like you hear people say "they took advantage of me when I was drunk"
Difficult to say. I went to a house party when I was, like, 16 and this girl I went to school with got wasted and lost her virginity that night. The next morning she was a sobbing, upset mess and said she "didn't mean to do it". It sucked, but would I blame the guy? No, tbh.

Obviously they wouldn't say that because they do not know what happened.
They weren't aware of the situation which makes it worse when in the worst possible way you got pregnant or caught a sexually transmitted disease not knowing where or from who you got it because you were so stoned.
Drugs are much worse and taking it with alcohol is not any better.
That's a really difficult thing to say.
I mean, if someone is out of their mind and can't reasonably make decisions I would say yes, it is rape.
But if someone if just tipsy and having fun and wants to hook up with someone, who also gives consent than I don't think there's anything criminal about it.
As long as both parties arranged to have sex ahead of time before drinking or if both agreed while both drunk, then no. It isn't. But if anyone EVER says "no" or "stop" then you stop, or it does become rape.
