It is designed in the same exact way a minor, who by law does not have
ANY legal capacity, can file charges, request for emancipation, request for legal representation, request to be independent on their W2's etc etc...minors have no outright given independent rights from their legal guardians (in most situations all deals made between a minor and another party will be made void), but if they seek such rights they it will be afforded to them if the courts find reason for the admission. And with every case brought before a court, before a person is bound by the law, a judge will always read you the rights that you have to amend all rulings, the same way a police officer will read your rights before you are arrested.
The due process clause of the 14th Amendment is there for a reason people
