I think this video coupled with the song is trying to show that even the sleeping nude bodies of celebrities become a big issue just because there are famous people in it. People wouldn't care if it were some random nude people in it. The controversy surrounding Kanye is just because he's famous.

There was a very high profile case involving Vanna White (hostess of Wheel of Fortune) suing Samsung for using her likeness satirically in a commercial, for example - she won the case.

Yeah, it's super basic business law - if he didn't then they can sue for damages, which will be significant if the song becomes popular or the video streams yield decent revenue for Tidal and/or Kanye.
