Obviously they wouldn't say that because they do not know what happened.
They weren't aware of the situation which makes it worse when in the worst possible way you got pregnant or caught a sexually transmitted disease not knowing where or from who you got it because you were so stoned.
Drugs are much worse and taking it with alcohol is not any better.

It can be, definitely. But if both parties are drunk, it sorta cancels out, as silly as that sounds. The judgement capacities of both people involved are impaired.
There's definitely a lot of gray area, as it's pretty damn difficult to tell where to draw the line and how intoxicated a person can be before it's considered taking advantage. Erring on the side of caution when fooling around with people who've been drinking is probably wise.
Being drunk doesn't mean you have no control/don't know what you're doing. That's a very old belief. Obviously if both parties agreed to do it, it's not rape. If one party forcefully took the other party's clothes off, it's rape.
Being high in drugs though, I'd consider rape though.

The logic behind "men can't be raped" is because a man has to be stimulated to achieve an erection. If he were physically appalled by someone, it would be impossible. In theory. It's a dumb ass saying, because rape goes beyond that, but that is why people make that assumption.
I'll just take the warning point and say you're extremely stupid. A person can literally get an erection and ejaculate while sleeping.
I don't think it's always rape (it obviously is if they're wasted and you're taking advantage of them) but it is very irresponsible and you shouldn't have sex with a drunk person if you're sober.
Getting a girl drunk so you can loosen her consent and have sex with her is rape. If the girl says 'Lets have sex!' it's a little different. It's not rape but you should still avoid it.

You know that alcohol gets you more 'out of control' than all of those right?
Drugs make you super aware of things whereas alcohol makes you totally unaware of them.
Actually, I think it would depend on the level of intoxication.
That's basically how I see it... of course it's a very grey area to say what's too far gone or not, but there's a difference between being regular drunk and ****ing plastered. That's when you stop being able to make sensible decisions that you might make when sober.
