Surrogate mom try to keep baby after find out about Gay Dads
Love won! Gay dads win custody of their one-year-old daughter from Thai surrogate mom who fought to keep her after finding out they were a gay couple
- Spanish-American couple Gordon Lake and Manuel Santos won custody of their one-year-old daughter Carmen on Tuesday
- Carmen is the biological daughter of Lake and an anonymous egg donor; She was born to Thai surrogate mother Patidta Kusolsang
- After the girl was born in January 2015, Kusolsang refused to sign papers allowing Lake and Santos to leave the country with their newborn daughter
- She claimed that she did not know that the couple was gay and objected to the baby be raised by two dads
- On Tuesday, a Thai judge recognized Lake as Carmen's legal guardian
- It will take another 15 months before the couple can return to Spain with Carmen, if Kusolsang decides to appeal the decision

The Bangkok court said in a statement that it granted custody to the couple, who live in Spain but have been caring for the 15-month-old in Bangkok, in order to 'protect the well-being of the baby'.
'Based on evidence and witness testimonies the judge was convinced that the girl's custodians took care of her with love,' it said.
'Their homosexuality is not an obstacle to raising the girl and to making her happy like any other child,' the statement added.
Lake and his partner, Spaniard Manuel Santos, both 41, have been stuck in Thailand since launching their legal battle after Carmen was born in January 2015.
Santos emerged from the court smiling and with tears in his eyes.

The case was seen as complicated by the fact that Thai law does not recognize same-sex marriages and also by a new law that bans commercial surrogacy, which took effect after Carmen's birth. Rachapol said the court's ruling was based on a transitory clause in the law allowing the intended parents of any baby born before the law took effect to request to be the legal parents.
When Carmen was born, Patidta handed over the baby to Lake and Santos, who left the hospital with the infant. But they say Patidtda then changed her mind and refused to sign the documents to allow Carmen to get a passport so they could leave Thailand.
Lake, who is from New Jersey, is Carmen's biological father, while the egg came from an anonymous donor, not Patidta. Neither he nor Carmen were in court Tuesday.
Lake and Santos were told Patidta had thought they were an 'ordinary family and that she worried for Carmen's upbringing,' according to a message Lake posted on a crowdfunding site that has raised $36,000 to help cover the costs of the trial and staying in Thailand.

The Bangkok-based New Life office has closed since commercial surrogacy was outlawed in Thailand in July 2015, following several high-profile scandals. There was a grace period provided for parents whose babies were already on the way.
Carmen has lived since birth with the couple, who also have a toddler son, Alvaro, born to a surrogate mother in India with Santos the biological father.

Couldn't they just adopt? It always repulses me when people rent a woman's body just to have half biological kids when 132 millions of children are orphans.

That's not even the issue. Some people want kids that are actually THEIRS. It is in NO WAY your right to tell these people what to do. If they want to legally 'rent' a woman's body, they can do that as they wish.

Adoption is a long and tedious proccess plus they want a mother/father combo for the kids so gay partners are swimming upstream since the start

Adoption for gay couples is legal in a lot of countries "long and tedious process" isn't a valid excuse.

This is so awful. Custody battles may be long. The girl will grow up and get attached to the surrogate mom and I sense that the case will not end up in their favor.
Commercial surrogacy is a bad idea, children are not goods to be bought. But in this case, the child belongs with the gays.

I didn't know you could pay people to cary your child, don't people usually ask someone they trust to do it, what if she found out earlier she could of runaway, or done harm to the child while in her body,
Remember while the child still in her it is a pat of her, its too much power
Those gays got lucky

Nobody should pay a woman to have their babies. I think that altruistic surrogacy is one of the most difficult and beautiful thing to do and that women that make those decisions do not get enough recognition for it.
However, if you don't have a loved one that can/want to be a surrogate, using a woman's financial precarity and renting her uterus is despiteful.
Commercial surrogacy is obviously a lot easier than adopting but it's definitely unethical and should be illegal everywhere.
