The controversial film infringed on the copyright of California actress Cindy Lee Garcia, who wanted the film pulled after claiming filmmaker Mark Basseley Nakoula tricked her into making the movie. The Muslim-mocking clip caused violent protests across the Arab world and may have been the impetus for the attack on the U.S. Embassy in Benghazi, Libya, on Sept. 11, 2012.

“Garcia’s performance was used in a way that she found abhorrent and her appearance in the film subjected her to threats of physical harm and even death,” Chief Judge Alex Kozinski wrote for the majority court. “Despite these harms, and despite Garcia’s viable copyright claim, Google refused to remove the film from YouTube.”
