You don't need to make money for it to be copyright infringement. Kim is displaying the product without permission AND credit. She even went as far as to put her own name on the product and claim it as her own.
Personally, I don't think it's that big of a deal. $150K for a picture of Halloween make-up seems silly. It's not like the artist was making any money from the product and Kim was redirecting that income into her own bank. I feel like the artist was pressured by others to go in on Kim, there are a lot of people out there that have it out for her.
