I hope they take it up because I think you have a good chances of SCOTUS ruling in favor of gay marriage.
Scalia, Thomas, and Alito would definitely not rule in favor of gay marriage.
Ginsburg, Breyer, Sotomayor, and Kagan would definitely rule in favor of marriage equality.
Kennedy and Roberts are pretty up in the air. They're both Catholic and Conservative, but they also tend to make their decisions based on the law, as opposed to their moral beliefs.
Kennedy wrote the majority opinion on the last two gay rights Supreme Court cases: Romer v. Evans (1996) and Lawrence v. Texas (2003); the majority in both cases having ruled in favor of equality. Before he was on the bench, Chief Roberts “worked behind the scenes for gay rights activists” in the Romer case who were represented at the time by his law firm, Hogan and Hartson.
