News: Cinemark Wants Shooting Victims To Pay $700k

With paperwork filed last week, the chain is seeking $699,187.13 in legal fees and other costs from the nearly 30 plaintiffs in the consolidated action. Those plaintiffs are victims and surviving family members of those killed in the July 20, 2012 shooting at the Aurora theater during a screening of The Dark Night Rises. Some are parents of those who gave up their lives saving others in the theater and others are those who were badly wounded.

As is true in many jurisdictions across the nation, state law in Colorado allows the winning side in a civil case to seek costs. After years of legal battling, Cinemark won the state case on May 19 when the 6-person jury delivered a unanimous verdict that the chain was not partially liable for the massacre that killed 12 and left 70 injured.

Cinemark did not respond to request for comment today on its latest legal moves in regards to the tragedy. Plaintiffs’ lawyer Marc Bern said last month that there likely would be an appeal of the verdict. Which means, this fees-and-costs filing could be a heavy-handed ploy by the chain in an attempt to halt any such appeal in return for dropping its own financial action.

On June 24, Cinemark was successful in having a federal case on the matter dismissed.“The Court concludes that a reasonable jury could not plausibly find that Cinemark’s actions or inactions were a substantial factor in causing this tragedy,” U.S. District Judge R. Brook Jackson wrote in his ruling. Cinemark was awarded “reasonable costs” in that case too, but have not sought out any payment as of yet.

I don't understand how the victims are responsible for the theatre shooting. Victims are the last people to blame/fine for a tragedy.

The victims sued Cinemark. They lost and now Cinemark wants them to pay 700k in legal fees

They don't want them to pay for the shooting - they want the family of/victims who filed a lawsuit against Cinemark to pay them for the legal fees for said lawsuits.

They're a big company who can most likely absorb the costs. This won't even be worth it when you consider the bad PR they're going to get from this

Cinemark doesn't realize this could backfire? 700k isn't worth the bad publicity. it may even be bad for all theaters. I mean don't they have a responsibility to ensure the safety of the people in the theater?

I mean it sounds incredibly insensitive as a headline like this and I have the utmost sympathy for the victims and families, but let's not act all morally outraged at a legal concept older than dirt. In certain situations, which vary by state, winning parties can recover the costs for their legal troubles.

This is true.

Moral outrage aside, (let's put on our thinking cap here) when a huge company like that wins a case; it's a pretty standard legal strategy to recoup the legal costs from the plaintiffs. It's smart because it intimidates the opposing potential parties from seeking a lawsuit if they know precedence won't favor a win in their favor. Whether you agree or not, it's what it is especially since they got sued over something they had no control over (theater shooting) nor had any reason to actually believe there was imminent danger.
