Rihanna's battle with David LaChapelle over her recent 'S&M' video is heading to trial.
A judge in New York granted the photographer permission to continue his case against a singer, in which he claims is "directly derived" from some of his work.
US District Judge Shira Scheindlin noted alleged similarities between the controversial music video, banned in 11 countries, and LaChapelle's images. Claims of trade-dress infringement, unfair competition and unjust enrichment were dismissed, but the charge of copyright violation was allowed.
A conference between the two camps is set to take place next month.
