Gay Marriage: Legal In All States & Territories - The End :)
- Supreme Court's October 6th denial of any case automatically meant the lower appeals court rulings stood and gay marriage came almost immediately to Indiana-Wisconsin-Virginia-Utah-Oklahoma who had sought the Supremes opinion.
- The 4th/7th/10th Circuit Courts Of Appeals had sided with gay couples and since their rulings are binding, that meant a layer has been lifted and all the remaining states in those districts had to do was either have a local judge wrap up any lawsuit or ask the circuit court for a direct order mandating the right to marry there. Colorado, West Virginia, North Carolina, South Carolina, Wyoming, Kansas have now started marrying couples.
- A day after the Supreme Court denial, Nevada and Idaho's bans were struck down by the 9th Circuit Court and the precedent was applied to the Western USA. Nevada and Arizona conceded and weddings have started. All of Idaho and Alaska's requests for reviews were denied by both lower courts and the Supreme Court, making the ruling there final. Montana became the last state in the 9th Circuit to fall and now the Western USA is complete
- Florida and Alabama were both struck down and all stays were denied so Florida starting marrying couples in January and Alabama in February. The 11th Circuit which controls Alabama-Florida-Georgia ruled in February that it won't be taking any appeals and that couples are free to marry. Sadly, Georgia's case has been frozen because couples didn't trust the judge and now that the 11th said no more new things, it's unlikely a second suit will come to light
Missouri has been struck down. The state had originally only agreed to recognize out of state marriages, but not that the full ban is down the Governor wants to let the ruling be while the AG will fight it. Counties have started marrying people on their own because the clerks said enough time has already been wasted
Arkansas was struck down in federal court and we expect them to file for an appeal to the 8th Circuit like Missouri.
South Dakota struck down on January 13, but stayed pending an 8th Circuit appeal like MO/AK.
Nebraska down on March 2, the ruling goes into effect on the 9th.
Mississippi has been struck down and the AG has asked for the 5th Circuit to review the case. It will be heard alongside Texas and Louisiana on January 9.
Arkansas state case is before the Arkansas State Supreme Court who are currently deliberating the issue.
Let's hope for the best
The Supreme Court will hear the 6th Circuit cases on April 28 and have a ruling by June, it may finally be over
---------------------------------------------------------------------------------------------------------------------------------------------------------------
- The 4th, 7th, 9th, 10th Circuits are completed
- The 6th Circuit which controls Michigan-Ohio-Kentucky-Tennesse has become the first to rule against couples, but unlike the other lower dissenting judges, the ruling focused more on state rights than gays destroying the world It was also a call for the Supreme Court to act since the Supremes had said they'd stay quiet until there was an appeals court disagreement. There's still time for a June 2015 nationwide ruling
- The 5th Circuit which controls Texas-Louisiana-Missippi had a hearing on TX/LA/MS appeals on January 9.
North Dakota's case (like Georgia) is frozen until the Supreme Court rules
- The 8th Circuit which controls North Dakota-South Dakota-Nebraska-Missouri-Arkansas* was supposed to hear Arkansas/Missouri/Nebraska/South Dakota's case on May 11, but they froze everything until the Supreme Court rules.
*Arkansas ban was struck down twice, the first time in state court which has no appeals court; their State Supreme Court who have the final word on state court cases heard the case on the same day one judge held a hearing on the federal case. The federal judge struck down the ban, but stayed it giving the state time to appeal to the 8th Circuit. Arkansas State Supreme Court case is still pending, but a decision may come before the end of the year as two judges are retiring. Let's hope it's 2 for 2
If it's tl;dr then just look at this image
